These Terms and Conditions apply to all visitors, customers, and anyone else who accesses the Site or requests services from Port Orange Deck & Fence.
Port Orange Deck & Fence provides residential and commercial deck construction, fence installation, screened enclosures, pergolas, and related outdoor structure services in Port Orange, FL and surrounding communities in Volusia and Flagler counties.
All services are performed by or under the direct supervision of state-licensed contractors. Services are subject to availability, permitting requirements, and conditions specific to each project site. We reserve the right to decline a project request at our discretion.
Written estimates provided by Port Orange Deck & Fence are based on a site visit, the scope of work described at the time of the estimate, and current material pricing. Estimates are valid for 30 days from the date issued unless otherwise noted in writing.
An estimate is not a contract. No work will begin until a written contract is signed by both parties. If the scope of work changes after a contract is signed - due to unforeseen site conditions, customer-requested changes, or changes in material availability - the contract price may be adjusted by written change order. We will notify you of any anticipated cost changes before proceeding with additional work.
Verbal quotes or ballpark figures provided before a site visit are approximations only and are not binding.
Project start dates are estimates based on our current workload, weather conditions, permit processing times, and material availability. We will communicate any delays as promptly as possible.
If you need to reschedule or cancel a project after signing a contract, please notify us in writing as soon as possible. Cancellation terms - including any deposits that may be retained - are specified in your written contract. If materials have been ordered for your project prior to cancellation, you may be responsible for the cost of those materials.
We reserve the right to suspend or terminate work on a project if site conditions are unsafe, if payment is not received as agreed, or if the customer materially breaches the contract.
Payment terms are set out in each individual project contract. In general, we require a deposit before work begins, with the remaining balance due upon project completion unless otherwise agreed in writing. Accepted payment methods will be stated in your contract.
If payment is not received by the due date stated in the contract, we reserve the right to suspend work until payment is made. Overdue balances may be subject to applicable collection remedies under Florida law.
Where required, Port Orange Deck & Fence will obtain the necessary building permits before work begins. Permit fees are typically included in your contract price; if they are not, they will be disclosed before the contract is signed. You are responsible for ensuring your property does not have deed restrictions, easements, or HOA rules that would prohibit the work. We can assist with HOA design guidelines, but HOA approval is your responsibility as the property owner.
We stand behind our workmanship. Any warranty terms for labor are specified in your written contract. Material warranties are provided by the manufacturer and are separate from our workmanship warranty. We do not extend manufacturer warranties beyond what each manufacturer provides.
Warranties do not cover damage caused by misuse, neglect, failure to follow care instructions, acts of nature (including hurricanes, flooding, or lightning), modifications made by anyone other than Port Orange Deck & Fence, or normal wear and tear.
The Site and all information on it are provided "as is" and "as available" without any warranty of any kind, express or implied. We do not warrant that the Site will be error-free or uninterrupted.
To the fullest extent permitted by law, Port Orange Deck & Fence will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or from any services provided, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or any services provided will not exceed the amount you paid us for the specific service that is the subject of the claim.
Some states do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
We prefer to resolve any dispute directly and informally. If you have a concern about a project or a charge, please contact us first at info@portorangedeckandfence.com or (386) 400-1327. We will make a genuine effort to resolve the issue promptly.
If we are unable to resolve the dispute informally, the parties agree to attempt non-binding mediation before initiating any litigation. Any legal action that proceeds to court will be filed in the state or federal courts located in Volusia County, Florida, and you consent to the jurisdiction of those courts.
These Terms and Conditions and any dispute arising from them are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
All content on this Site - including text, images, logos, and design - is the property of Port Orange Deck & Fence or its content suppliers and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any content on this Site without our prior written permission.
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date.
